In response, workplace safety has become a priority. Many states are improving their laws to require mandatory anti-sexual harassment training for companies as small as 5 employees. <\/span><\/p>\n<p><\/p>\n<p><span style=\"font-weight: 400;\">Here are the states that have updated their laws and now require employers to provide harassment training by the end of 2019:<\/span><\/p>\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/aceaglobal.com\/continuing-education-journal\/wp-content\/uploads\/2019\/04\/middle-pic-1024x683.jpg\" alt=\"\" class=\"wp-image-156\" srcset=\"https:\/\/aceaglobal.com\/continuing-education-journal\/wp-content\/uploads\/2019\/04\/middle-pic-1024x683.jpg 1024w, https:\/\/aceaglobal.com\/continuing-education-journal\/wp-content\/uploads\/2019\/04\/middle-pic-300x200.jpg 300w, https:\/\/aceaglobal.com\/continuing-education-journal\/wp-content\/uploads\/2019\/04\/middle-pic-768x512.jpg 768w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n<ul>\n<li><span style=\"font-weight: 400;\">New York State<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">New York state\u2019s sexual harassment policy was enacted in October, 2018. It requires every employer, regardless of size, to adopt an anti-sexual harassment policy and provide training to all employees by the end of 0219. If you are a New York employer who would like details about how to comply, we have had <\/span><a href=\"https:\/\/aceaglobal.com\/continuing-education-journal\/legal\/new-york-sexual-harassment-laws-policies-training-workplace\/\"><span style=\"font-weight: 400;\">another article <\/span><\/a><span style=\"font-weight: 400;\">to walk you through the nitty-gritty. <\/span><span style=\"font-weight: 400;\"><br><\/span><span style=\"font-weight: 400;\"><br><\/span><b>Required Training:<\/b><b><br><\/b><span style=\"font-weight: 400;\">The deadline to have the required training in place for employees has been extended to October 9, 2019. Note: This is annually-based training instead of one-time training.<\/span><\/p>\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/aceaglobal.com\/continuing-education-journal\/wp-content\/uploads\/2019\/04\/NYS-harassment-training-requirements-410x1024.png\" alt=\"\" class=\"wp-image-157\" width=\"402\" height=\"1003\" srcset=\"https:\/\/aceaglobal.com\/continuing-education-journal\/wp-content\/uploads\/2019\/04\/NYS-harassment-training-requirements-410x1024.png 410w, https:\/\/aceaglobal.com\/continuing-education-journal\/wp-content\/uploads\/2019\/04\/NYS-harassment-training-requirements-120x300.png 120w\" sizes=\"auto, (max-width: 402px) 100vw, 402px\" \/><\/figure><\/div>\n\n\n<ul>\n<li><span style=\"font-weight: 400;\">Delaware<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The new Delaware sexual harassment law went into effect on January 1, 2019. However, unlike New York State, independent contractors, applicants and employees hired under 6 month are not required to be trained. <\/span><\/p>\n<p><\/p>\n<p><b>Required Training:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The training should include the following points:<\/span><\/p>\n<ol>\n<li><span style=\"font-weight: 400;\"> The laws around sexual harassment;<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> The definition of sexual harassment using examples;<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> The legal remedies and complaint process available to the employee.<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> Directions on how to file a complaint.<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> The legal prohibition against retaliation.<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Some important timelines you should keep in mind if you are an employer in Delaware&#8211;<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Each employer must distribute the <\/span><a href=\"https:\/\/dia.delawareworks.com\/discrimination\/documents\/Delaware%20Sexual%20Harassment%20Notice.pdf?20181114\"><span style=\"font-weight: 400;\">Department of Labor\u2019s Sexual Harassment Notice<\/span><\/a><span style=\"font-weight: 400;\"> to each new employee upon commencement of employment, and to each existing employee <\/span><b>by July 1, 2019.<\/b><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Workplace with 50+ employees are required to complete an <\/span><span style=\"font-weight: 400;\">interactive training <\/span><span style=\"font-weight: 400;\">(at least 90 minutes and education to employees regarding the prevention of sexual harassment) on sexual harassment <\/span><b>by the end of 2019<\/b><span style=\"font-weight: 400;\">. Additionally, training to supervisors about their responsibilities and the retaliation prohibitions is also mandatory.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">For new employees, the training must be provided within a year of the commencement of their employment.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">For <\/span><b>new supervisors<\/b><span style=\"font-weight: 400;\">, the additional interactive training must be provided within one year of commencement of their position.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">For existing employees and supervisor, they must receive sexual-harassment training <\/span><b>by January 1, 2020<\/b><span style=\"font-weight: 400;\"> (within one year of the effective date of the statute).<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Training should be repeated every 2 years.<\/span><\/li>\n<\/ol>\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/aceaglobal.com\/continuing-education-journal\/wp-content\/uploads\/2019\/04\/cali-middle-pic-1024x683.jpg\" alt=\"\" class=\"wp-image-159\" srcset=\"https:\/\/aceaglobal.com\/continuing-education-journal\/wp-content\/uploads\/2019\/04\/cali-middle-pic-1024x683.jpg 1024w, https:\/\/aceaglobal.com\/continuing-education-journal\/wp-content\/uploads\/2019\/04\/cali-middle-pic-300x200.jpg 300w, https:\/\/aceaglobal.com\/continuing-education-journal\/wp-content\/uploads\/2019\/04\/cali-middle-pic-768x513.jpg 768w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n<ul>\n<li><span style=\"font-weight: 400;\">California<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The new California sexual harassment law went into effect on January 1, 2019. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">By <\/span><b>January 1, 2020, <\/b><span style=\"font-weight: 400;\">every<\/span> <span style=\"font-weight: 400;\">employer in California who employs <\/span><b>5 or more<\/b><span style=\"font-weight: 400;\"> employees, including temporary or seasonal employees, must provide at least<\/span><b> one hour<\/b><span style=\"font-weight: 400;\"> of anti-sexual harassment training for employees and at least <\/span><b>2 hours<\/b><span style=\"font-weight: 400;\"> for supervisors. Notably this training should be repeated every 2 years for all employees.
